General terms and conditions Realize Mode VOF

(A). Definition:

In these conditions the following definitions apply:
1. entrepreneur: the natural or legal person who offers products and/or services remotely to retailers;

2. retailer: the natural person who does not act in the exercise of a profession or business and who enters into a distance contract with the entrepreneur;

3. distance contract: an agreement in which, within the framework of a system organized by the entrepreneur for distance sales of products and/or services, exclusive use is made of one or more techniques for communicating on distance;

4. reflection period: the period within which the retailer can exercise his right of withdrawal;

5. right of withdrawal: the option for the retailer to cancel the distance contract within the cooling-off period;

6. day: calendar day;

7. duration transaction: a distance contract relating to a series of products and/or services, the delivery and/or purchase obligation of which is spread over time;

(C). Applicability:

1. These general terms and conditions apply to every offer from Realize Mode VOF and to every distance contract concluded between the entrepreneur and the retailer.

2. Realize Mode VOF has the right to change these General Terms and Conditions and the content of its website. For agreements already concluded, the conditions that were valid at the time the agreement was concluded remain in force.

3. Before the distance contract is concluded, the text of these general terms and conditions will be made available to the retailer. If this is not reasonably possible, before the distance contract is concluded, it will be indicated that the general terms and conditions can be viewed at the entrepreneur and they will be sent free of charge as soon as possible at the retailer’s request.

4. If the distance contract is concluded electronically, notwithstanding the previous paragraph and before the distance contract is concluded, the text of these general terms and conditions can be made available to the retailer electronically in such a way that it can be read by the retailer. retailer can be easily stored on a durable data carrier. If this is not reasonably possible, before the distance contract is concluded, it will be indicated where the general terms and conditions can be viewed electronically and that they will be sent free of charge electronically or otherwise at the retailer’s request.

(D). Agreement

1. The agreement between you and realizemode.nl is concluded when you:

• Placed an order via the Realize Mode website (www.realizemode.nl) by logging in and a fully completed order form.

2. If the retailer has accepted the offer electronically, the entrepreneur will immediately confirm receipt of the acceptance of the offer electronically. As long as receipt of this acceptance has not been confirmed, the retailer can terminate the agreement.

4. If the agreement is concluded electronically, the entrepreneur will take appropriate technical and organizational measures to secure the electronic transfer of data and ensure a secure web environment. If the retailer can pay electronically, the entrepreneur will take appropriate security measures.

5. The entrepreneur can – within legal frameworks – inquire whether the retailer can meet his payment obligations, as well as all those facts and factors that are important for a responsible conclusion of the distance contract. If, based on this investigation, the entrepreneur has good reasons not to enter into the agreement, he is entitled to refuse an order or request with reasons or to attach special conditions to the execution.

(E). Delivery & payment

1. When purchasing products, the retailer has the option to terminate the agreement without giving reasons within fourteen days. this period starts on the day after receipt of the product by or on behalf of the retailer.

2. During this period, the retailer will handle the product and packaging with care. He will only unpack or use the product to the extent necessary to assess whether he wishes to keep the product. If he exercises his right of withdrawal, he will return the product to the entrepreneur with all accessories supplied and – if reasonably possible – in the original condition and packaging, in accordance with the reasonable and clear instructions provided by the entrepreneur.

3. Realize mode carefully packages all products for shipment and is therefore not liable for damage or loss of items during shipment.

4. Offers are valid while supplies last.

5. Deviations in color, type, text and/or price changes reserved

6. Delivery takes place after we have received payment via internet banking.

7. The shipping costs within the Netherlands are €7.95 excl. VAT per box.

Shipping costs for Germany and Belgium are €14.95 excl. VAT per box.
Other zones will be calculated after receipt of the order.

(F). Article 5b – right of withdrawal upon delivery of services
1. Upon delivery of services, the retailer has the option to terminate the agreement without giving reasons for a period of fourteen days, starting on the day of entering into the agreement.

2. To exercise his right of withdrawal, the retailer will follow the reasonable and clear instructions provided by the entrepreneur with the offer and/or at the latest upon delivery.

3. The goods are in their original condition, not worn, not washed, with tags attached, item is unchanged, treated with care and not perfumed.

4. If the retailer exercises his right of withdrawal, a maximum of the costs of return will be borne by the retailer.

5. If the retailer has paid an amount, the entrepreneur will refund this amount as soon as possible, but no later than 30 days after the return or cancellation.

(G). Complaints

1. The entrepreneur has a sufficiently publicized complaints procedure and handles the complaint in accordance with this complaints procedure.

2. Complaints about the execution of the agreement must be submitted fully and clearly described to the entrepreneur within a reasonable time, after the retailer has discovered the defects.

3. Complaints submitted to the entrepreneur will be answered within a period of 14 days from the date of receipt. If a complaint requires a foreseeably longer processing time, the entrepreneur will respond within 14 days with an acknowledgment of receipt and an indication of when the retailer can expect a more detailed response.

(H). Liability

1. Realizemode.nl cannot be held liable for any damage, whether physical, material or immaterial, resulting from poor functioning or incorrect use of the products sold by us.

2. Realizemode.nl cannot be held liable for damage of any kind resulting from the website and/or decisions based on information from this site

(I). Straight

1. Dutch law applies to the relationship between Realizemode.nl and the customer.
